Terms of use
Draft — to be reviewed by GoT&T’s legal advisor. Text in [brackets] is still to be completed.
1. About these terms
These terms are an agreement between you and GoT&T Logistics LTD (“GoT&T”, “we”). They apply when you use the GoT&T app to ride or to drive. By creating an account you accept them. Our privacy policy explains how we handle your data.
GoT&T is an app that connects riders with local drivers in Trinidad and Tobago. Drivers use their own vehicles. [Legal advisor: define GoT&T’s role — booking platform or transport provider — and the drivers’ status.]
2. Your account
- You must be at least [18] years old.
- One account per phone number. You sign in with a code sent by SMS — keep your phone safe, because whoever has it can use your account.
- Give your real name. Before your first ride we ask for one photo of your national ID or passport.
- You are responsible for what happens in your account.
3. Booking a ride
- Before you book, the app shows a price range for each vehicle type (Standard, Luxury, Large). It is an estimate.
- The final fare is calculated from the distance and duration of the trip. At busy times a peak-hour rate may apply; it is already included in the price range you see. Prices are in TT$.
- Your request goes to nearby drivers. The first driver who accepts gets the ride. Drivers see the destination and estimated fare before accepting.
- You can ride now or schedule a ride. We try to find a driver for the scheduled time, but we cannot guarantee one. If no driver is found, we tell you.
- Vehicle types show how many seats are available: Standard 4, Luxury 4, Large 6.
4. Paying in cash
- GoT&T is cash only. At the end of the trip you pay the driver the final fare shown in the app, in cash.
- GoT&T does not take card payments and does not hold riders’ money.
- If you disagree with a fare, contact our office. [Legal advisor: fare dispute process.]
5. Cancelling
Cancelling is free for riders and for drivers. If someone cancels very often or often does not show up, we may limit their account.
6. Riders
- Be at the pickup point on time and ride with no more people than the vehicle has seats.
- Treat drivers and their vehicles with respect. You may have to pay for damage you cause. [Legal advisor: damage and cleaning costs.]
- Wear a seat belt and follow the law.
7. Drivers, deposit and commission
- Approval. To drive you need an approved GoT&T driver account. You apply in the app with “Drive with GoT&T”.
- Vehicle. You drive your own vehicle, 2015 or newer, in good and safe condition. [Legal advisor: licensing required for vehicles for hire.]
- Documents. National ID, driver’s permit, proof of residence, police certificate of character and insurance. They must be valid and you must tell us when they change or expire.
- Deposit. You pay a deposit to the GoT&T office. The office records it in your account, and the app shows your balance.
- Commission. You collect every fare from the rider in cash. When a ride is completed, GoT&T’s commission (currently 20% of the fare) is deducted from your deposit automatically. Example: deposit TT$1,000, ride fare TT$300, commission TT$60, new balance TT$940.
- If your balance is below the minimum set by GoT&T, you cannot go online until you top it up. We will tell you [N days] in advance if the commission rate changes.
- While online keep the app open; you only receive ride requests while it is open. You may decline any request.
- You are responsible for your own taxes, licences and insurance. [Legal advisor: independent contractor wording.]
- If you stop driving, the unused part of your deposit [is refunded by the office within N days].
8. Prohibited use
You must not:
- use the app for anything illegal, or carry illegal goods or weapons;
- threaten, harass, discriminate against or hurt anyone;
- drive under the influence of alcohol or drugs, or without a valid permit and insurance;
- create fake rides, fake accounts, or use someone else’s account or documents;
- use another person’s phone number or details from a ride for anything other than that ride;
- copy, reverse-engineer, overload or interfere with the app or our servers.
9. SOS and safety
- The red SOS button is for real emergencies and safety concerns during a trip. When you press it, our 24/7 office is alerted, sees your live location and may call the police.
- SOS does not replace the emergency services. If your life is in danger, call the police on 999.
- SOS works only while your phone has signal and the app is open.
- Pressing SOS on purpose without a reason, or misusing it, can lead to suspension of your account and may be reported to the police. If you press it by mistake, cancel it in the app — that is not misuse.
10. Ratings
Riders can rate drivers after a trip. Ratings must be honest. We may use low ratings or complaints to review an account.
11. Suspension and closing
We may suspend or block an account that breaks these terms, puts others at risk, or uses false documents. You can delete your account at any time in the app (how to delete your account).
12. Liability
The app depends on mobile networks, GPS and third-party services, so we cannot promise it will always be available or error-free.
[Limitation of liability — to be drafted by GoT&T’s legal advisor: GoT&T’s liability for rides, delays, lost items, injuries and damage; drivers’ insurance; what cannot be excluded by law.]
13. Changes
We may change these terms. We will update the date at the top and, for important changes, tell you in the app before they apply. If you keep using the app after that, the new terms apply.
14. Law and contact
These terms are governed by the laws of the Republic of Trinidad and Tobago [confirm; courts of Trinidad and Tobago].
